General travel conditions
from Pasjona Safaris & Car Hire cc
1) Contract between the Traveller and Pasjona Safaris & Car Hire cc:
With the application for a tour, the Traveller offers Pasjona Safaris & Car Hire cc the conclusion of a binding travel contract. The application can be made in writing, verbally or by telephone. To secure a booking with Pasjona Safaris & Car Hire cc, a Traveller or Client must deposit 20% of the entire price of the trip. All flights (domestic and international) must be paid 100% in advance to secure spaces. The deposit is non-refundable.
A booking is accepted and becomes definite from the date Pasjona Safaris & Car Hire cc has received the deposit from the Traveller. It is at this point that a binding contract between Pasjona Safaris & Car Hire cc and the Traveller comes into existence.
The contract is made between Pasjona Safaris & Car Hire cc, and the Traveller, which includes all persons named on the booking form. The person signing the booking form warrants that he/she has full authority on behalf of all the persons whose names appear thereon and confirms that all such persons are fully aware of and accept these conditions.
2) Deposit and payment:
With the complete confirmation a 20% non-refundable deposit of the tour price is due (for guided tours and fly-in safaris 25%). The difference is payable up to 30 days before departure. Bookings made less than 30 days before departure have to be paid in full immediately.

3) Prices of tours:
These are explicitly confirmed by Pasjona Safaris & Car Hire cc for each tour booked. The Company reserves the right to increase the price of any tour prior to departure due to factors beyond the control of the Company, such as, without being limited to, and increase in fuel prices, new Government legislation, accommodation price increases, fluctuations in exchange rates, etc.
If the Company announces an increase in the tour price in terms of this Clause, such addition amount must be paid to the Company before the departure of such tour or else the Company shall have the right to cancel the tour and the charges in Clause 6 will apply.
4) Services:
The travel services offered are in principle the standard services offered by Pasjona Safaris & Car Hire cc and the relevant services mentioned in the travel confirmation. Collateral agreements that extend the scope of the contractual services must be explicitly confirmed by Pasjona Safaris & Car Hire cc.
5) Change and redesign of the itinerary:
Pasjona Safaris & Car Hire cc shall at any time have the right, in its entire discretion, to alter the terms of the booking in relation to the route, timetable, itinerary and accommodation. The Company shall, however, make every effort to offer the Traveller an alternative tour of a comparable standard. Should the alternative be of a lesser standard, the Traveller will be refunded the difference, but should there be an increase, the Traveller shall have the right to either reject the alternative and obtain a refund of the relevant portion of the original contract sum, or to accept the alternative and pay the increased cost. In the event of the Traveller rejecting the alternative tour and claiming a refund, such rejection will be treated as a cancellation and the refund will be calculated according to Clause 6 hereof. The Traveller shall have no claim against Pasjona Safaris & Car Hire cc for any damages arising out of the alternative booking.
Force majeure is war, threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline or aircraft type, or other similar events beyond the control of Pasjona Safaris & Car Hire cc.
All vehicles are equipped with air conditioning.
6) Resignation by the Traveller:
The Traveller may cancel the booking at any time provided that the cancellation is communicated to Pasjona Safaris & Car Hire cc in writing. Deposit paid to reserve a trip is non-refundable. All other reservations cancelled less than 45 days prior to the departure date of the tour are subject to the following cancellation fees.
Should the Traveller fail to cancel the Booking, Package or arrangement with Pasjona Safaris & Car Hire cc, the Traveller will be liable for paying the full Booking price for the tour or arrangement.
Should a Traveller fail to arrive, Pasjona Safaris & Car Hire cc will be entitled to treat the reservation as cancelled without giving the Traveller notice and the provisions of the Cancellation by Traveller clause will apply.
The following percentages are decisive for this:
From booking confirmation:
A non-refundable deposit of 20% of the travel price is charged, thereafter
Until the 45th day before departure: maximum 30% of the travel price
Up to the 31st day before departure: maximum 40% of the travel price
Up to the 21st day before departure: maximum 50% of the travel price
Until the 14th day before departure: maximum 60% of the travel price
Until the 7th day before departure: maximum 80% of the travel price
From the 6th day before departure: maximum 100% of the travel price
In case of no-show on the agreed date of travel 100% of the tour price
The final amount of the compensation claim is in all cases based on the costs that can be saved and on what can be acquired by using the travel services elsewhere. But it will not exceed the mentioned cancellation rates, even in the worst case.
If the Traveller wishes to change certain services after having received the travel confirmation from Pasjona Safaris & Car Hire cc, the costs normally incurred are the same as for a cancellation. For minor changes, Pasjona Safaris & Car Hire cc is entitled to charge N $ 500.00 processing fee per transfer.
Until the start of the journey, each registered participant can be replaced by another person. This requires timely notification to Pasjona Safaris & Car Hire cc in writing. The organizer may, however, object to the change of the person of the substitute traveller if the replacement person does not meet the special travel requirements or opposes legal regulations or official orders. We recommend the conclusion of a travel cancellation insurance, which is not included in the travel price.
7) Unused benefit:
No refund will be made by Pasjona Safaris & Car Hire cc if, for any reason, inclusions or parts of the tour cannot be carried out / or utilised. These would include all facets such as road transfers, meals, game drives, accommodation etc. This would also apply to any Traveller who has booked a tour but fails to undertake the tour for any reason. We will however try our best to get a refund from the relevant supplier/agent for services, etc. not utilized. This is only possible if Pasjona Safaris & Car Hire cc is informed in time.
8) Responsibility:
Pasjona Safaris & Car Hire cc enjoys comprehensive insurance cover in the form of comprehensive and third-party liability insurance for vehicles that also include passengers. Pasjona Safaris & Car Hire cc and travel agencies working with the company, act in all cases only as intermediaries for the guest and therefore accept no responsibility for any delays, losses or damages, for whatever reason.
Pasjona Safaris & Car Hire cc cannot guarantee the accuracy of any hotel, resort or other leaflet which is not published by them but may be supplied as an additional service to the Traveller.
Pasjona Safaris & Car Hire cc acts only in the capacity of an agent upon the legal conditions that, while exercising every possible precaution, it is not responsible for injury, illness, damage, loss, additional expenses, accidental delay, or other irregularities which may be caused either through wilful or negligent acts or omissions made by the companies or individuals providing or engaged in transportation, accommodation or other services related to the accomplishment of the tour, or through natural disasters, social upheavals or other causes.
All scheduled and unscheduled trips as well as rental arrangements, itineraries, travel arrangements, hotel accommodations, etc. may be changed or cancelled at any time without notice if, for any reason whatsoever, such change or cancellation is desirable, expedient or necessary; especially as regards the services or unfavourable circumstances of the contractual partners of Pasjona Safaris & Car Hire cc such as hotels, restaurants, transport companies or other entities.
9) Luggage for group travel / self-drive tours:
20 kg of luggage is free. That would be about a suitcase and a piece of hand luggage per person. The luggage must be clearly marked. For groups and self-drive tours, despite the care taken by Pasjona Safaris & Car Hire cc, we assume no responsibility for lost or damaged luggage. It is the onus and responsibility of the client to obtain the necessary comprehensive insurance before departure for any possible cancellations, medical expenses, protection or personal property and money.
10) Visas, health and entry requirements:
It is entirely the Traveller’s duty to ensure that all passports & visas are current, valid, obtained on time and that any vaccinations, inoculations, prophylactics (e.g. for malaria) and the like, where required, have been obtained.
Personal accident, emergency evacuation and repatriation and personal liability cover as well as for loss of or damage to personal belongings are also strongly recommended. Pasjona Safaris & Car Hire cc will not be responsible or liable if the Traveller fails to take adequate insurance cover or at all.
11) Arrival by group travel / self-drive tours:
Travellers should be at the departure point 30 minutes prior to departure. Unfortunately waiting for late passengers is not possible. Pasjona Safaris & Car Hire cc accepts no responsibility for passengers who miss the connection. In the case of self-drive tours, Pasjona Safaris & Car Hire cc cannot be held responsible if, for various reasons, the arrival is delayed. If possible, please contact Pasjona Safaris & Car Hire cc when you arrive in Windhoek.
12) Invalidity of individual provisions:
Any approved changes within the contract does not render the contract as a whole invalid.
13) Jurisdiction:
Namibian law and the jurisdiction of Namibian courts will govern the relationship between the Traveller and Pasjona Safaris & Car Hire cc.
